The trial of Drak

The soldier of Waterdeep is bringing the accused Drak to his trial at the Halls of Justice.

Drak walks in from the east.
You say 'Your defence wants a word with you before I take you to trial.'
You say 'Wait here'
Drak peers intently about the area.
You say 'She will be here shortly'
Drak asks 'She?'
You ask 'Yes your defense is a woman. Is that a problem?'
A soldier of waterdeep bristles.
Drak asks 'No... who is she?'
Guiava the lawyer walks in from the east.
Guiava the lawyer bows deeply.
Drak looks at Guiava the lawyer.
You bow before her.
Drak looks at Guiava the lawyer.
I look at her also and this is what I see.
This tall, striking woman walks confidently and swiftly.
She carries her papers with confidence, and her
ice-blue gaze almost compels you to tell her what she wants to hear.
Guiava the lawyer is in perfect health.
Drak nods at Guiava the lawyer.
Guiava the lawyer asks you 'I assume this is the defendant?'
You nod at her.
You say 'yes ma'am'
Guiava the lawyer asks you 'may I have a moment with him alone?'
Drak peers intently about the area.
You nod.
Drak sits down.
I walked into another part of the temple. But from where I sat I could hear them talking. I did not want to leave the young lady alone with the accused as I feared for her safety.
Guiava the lawyer sighs loudly.
Drak asks Guiava the lawyer 'What will be my punishment?'
Guiava the lawyer says 'that depends'
Drak asks 'of what?'
Guiava the lawyer asks 'first, what are they saying you did?'
Drak says 'Murder.. with witnesses'
Guiava the lawyer says 'so there's no question you did it then'
Drak nods.
Guiava the lawyer says 'so what we need to do is show why'
Guiava the lawyer says 'paint it in a way that shows the fine people of Waterdeep you did it cos you had to'
Guiava the lawyer asks 'but first, why did you do it?'
Drak says 'Kendarick isulted me several time'
Guiava the lawyer pulls out a quill and starts taking notes.
Drak says 'I asked a paladin for a duel but the pansy elf didn't want...'
Guiava the lawyer says 'first thing'
Guiava the lawyer says 'no calling people pansies in court'
Drak says 'I told him to retract his words.. intead he insulted me again'
Guiava the lawyer says 'you and I both know elves are pansies, but that's just us talking'
Guiava the lawyer winks at you.
You nod at her.
Guiava the lawyer asks 'why bring the paladin into it at all?'
Drak says 'Aedwyn was there when he insulted me'
Guiava the lawyer asks 'and what was the insult?'
Drak says 'I kept saying in front of everyone that I was evil'
Drak says 'ooc err he'
Drak says 'I draw my sword and he continued to say it'
Guiava the lawyer writes furiously.
Guiava the lawyer says 'good, good'
Guiava the lawyer asks 'did you provoke him?'
Drak says 'He was looking for it...'
Guiava the lawyer says 'into the insults, I mean'
Drak says 'I said a comment about tree huggers'
Drak says 'He took it personnaly'
Guiava the lawyer rolls her eyes.
Guiava the lawyer says 'no idea why they come in the damned city anyway'
Guiava the lawyer keeps writing.
Drak nods.
Guiava the lawyer asks 'did you warn him at all?'
Drak says 'We could say that I didn't mean to kill him.. just to teach him a lesson'
Guiava the lawyer says 'we could also say the paladin should have done more to protect this Kendarick from himself'
Drak nods at Guiava the lawyer.
Guiava the lawyer says 'and also, that you were defending your honour'
Drak says 'Aye'
Drak says 'I had that kind of conflict before and I retracted my words before anything happened'
Guiava the lawyer says 'I need you to be the vision of honourable in there'
Drak says 'Yes'
Drak says 'I will'
Guiava the lawyer says 'this town doesn't like killers much'
Drak nods.
Guiava the lawyer closes her ink-pot.
Guiava the lawyer says 'best possible outcome, you'll probably lose a limb'
You ask 'What about the worst?'
Guiava the lawyer says 'worst outcome, they'll hang you from that sissy fountain in the town square'
Drak smirks.
Drak says 'What a pathetic end'
Guiava the lawyer says 'let's hope it doesn't come to that - I have a hard time collecting my fees from dead men'
Drak smirks.
Drak asks 'What are your fees?'
Guiava the lawyer says 'we'll arrange that afterward'
Drak nods.
Guiava the lawyer gives her best lawyer smile.
Guiava the lawyer asks 'ready?'
Drak says 'Yes'
Guiava the lawyer sticks her head out the door, looking for the guard.
Drak peers intently about his surroundings.
Guiava the lawyer says 'we're ready'
I go back in and lead the accused to his trial.
Drak says 'Very well.'

The High Justicar walks in from the north.

Telisyn nods at Caius.
Summer mutters to Veritas, 'It is better that I keep my hands together.'
Mouat kneels.
Caius quickly returns the many bottles to his pack.
Shadrim turns and whispers to the crowd.
Veritas bows his head slowly.
Arialle bows her head.
The high justicar asks Veritas 'Are we ready, my son?'
Veritas rises up.
Veritas nods.
Drak stands proudly in front of the justicar.
Veritas says to The High Justicar 'I believe so your Honour'
The high justicar says 'I now call this trial to order.'
The high justicar says 'Drak is accused of the murder of Kendarick.'
The high justicar asks 'Who will stand for the accused?'
Guiava the lawyer bows before The High Justicar.
Guiava the lawyer says 'I will'
The High Justicar nods at Guiava the lawyer.
The high justicar says to Veritas 'Tell us what has happened please.'
Caius closes his alcohol pack and turns his attention to the trial.
The High Justicar chants a short prayer.
Eltsac smiles at Caius.
The high justicar says 'All here are bound by the truth. There will be no falsehoods.'
Veritas says 'The detailos will be made clear as the trial progresses, The accused was seen to blatantly murder Kendarick in front of those in Market Square'
Veritas says 'This action was not provoked and is no way protected under the laws of Waterdeep'
Veritas bows before The High Justicar.
Veritas sits down.
A fighter flys in in from the south.
Eltsac looks at A fighter.
The high justicar asks Guiava the lawyer 'Have you anything to say before the witness' are called?'
Guiava the lawyer nods.
Telisyn looks at A fighter.
Mouat looks at A fighter.
Kendarick looks at A fighter.
Guiava the lawyer says 'That Drak killed Kendarick can not be disputed...as has been said, there were witnesses'
Guiava the lawyer says 'However, the claim that it was not provoked is untrue'
Guiava the lawyer says 'It was provoked. Kendarick had ample chance to avoid his ultimate demise...and others had a chance to protect Kendarick from himself and did nothing'
Guiava the lawyer says 'in fact, Drak was merely protecting his honour'
Dov frowns.
Guiava the lawyer says 'we hope the trial will bring this truth to light'
Guiava the lawyer bows before The High Justicar.
Mouat sits down and thinks deeply.
Guiava the lawyer sits down.
Drak was Shadrim's stooge and he could what he wanted
The High Justicar nods at Guiava the lawyer.
The high justicar says to Veritas 'You may call a witness.'
Veritas rises up.
Veritas says 'If It pleases the court I call first to the stand Sir Aewdyn, Sword of Tyr'
Veritas says 'ooc hmmms aedwyn is voided'
Guiava the lawyer looks around.
Veritas says 'If it pleases the court I call Summer the Sorceress to the stand'
Summer rises up.
The High Justicar nods at Summer.
Summer rises and moves to the front of the room. She curtsies gracefully before the high justicar before taking the spot indicated.
Aedwyn has returned from the void.
Veritas asks 'Summer, You were present the night of this murder in waterdeep no?'
Summer says 'Yes, sir knight, I was present.'
Veritas asks Summer 'You are under a truth oath so your word will be taken as fact, can you please tell us what lead up to this horrific event?'
Summer composes herself and chooses her words with care, her Dalesland accent coloring her words slightly, 'I was in the Market Square. Sir Aedwyn, Kendarick, and Drak were present.'
Summer says ''Kendarick introduced himself to Drak, and Drake used the word 'treehugger' in a disparaging tone. Sir Aedwyn noted that some might take offense to that term.'
Caius mutters.
Veritas asks 'Treehugger you say?'
Summer nods at Veritas.
Arialle shakes her head.
Mouat gasps.
Dov sighs loudly.
Summer says to Veritas 'Aye.. treehugger.'
Guiava the lawyer smirks and writes something.
Veritas says to Summer 'continue please'
Summer says 'Kendarick was upset by this remark. He called Drak evil and the burst in to tears, leaving the Square. Drak demanded a duel immediately, Sir Aedwyn attempted to defuse the situation.'
Summer says 'I noted that I also might find this term insulting, and Drak claimed that it was not his intention to insult me, but he seemed quite intent on a duel to satisfy the insult that Kendarick had delivered.'
Summer says 'Sir Aedwyn left the Square. Not long after, Kendarick returned.'
Summer says 'A few words were exchanged, and Kendarick commented that he supposed that evil people did not need manners. Drak asked him to repeat the remark, and he did so.'
Summer says 'Drak then attacked the guard that patrols the Market Square. He fled the battle, leaving his horse behind. He then returned, re-engaged the guard and fled again, this time taking his horse with him.'
Veritas asks Summer 'why would he attack the guard?'
Summer says 'He returned yet again, claiming that 'this is what I meant to do' and attacked Kendadrick.'
Guiava the lawyer rises up.
Guiava the lawyer says 'objection, asking the witness to speculate on my client's thoughts'
Veritas raises an eyebrow.
Drak says 'ooc Attacking the guard was my mistake.. I meant to attack Kendarick and I said oocly that it was a typing mistake'
Veritas says 'I strike the question your honor'
Guiava the lawyer sits down.
The high justicar asks 'Summer, did you use magic to determine the accused's state of mind?'
Summer says 'No, your lordship. That magic is beyond the power of the Guild of Mages, and I would not have used an invasive magic in the Market Square.'
Veritas asks Summer 'Were terms set for a duel and was a duel mutually agreed upon?'
Summer says to Veritas 'No, sir knight.'
Veritas asks Summer 'so this duel was no duel at all then, but an attack here in Warterdeep?'
Veritas strokes his mustache thoughtfully.
Guiava the lawyer rises up.
Guiava the lawyer says 'objection'
Mouat sighs loudly.
Veritas raises an eyebrow.
The High Justicar raises an eyebrow at Guiava the lawyer.
Guiava the lawyer asks 'isn't what the events were what is being established here in this courtroom by the high justicar?'
Arialle looks confused.
Guiava the lawyer asks 'and not Summer?'
Summer looks to the High Justicar.
Mouat is puzzled as to what Guiava means.
Veritas says 'The witness was present and so her testimony carries considerable weight'
Guiava the lawyer says 'but as to whether she can say if it was an attack or a duel...'
Dov looks puzzled
Dov shakes his head.
Veritas says 'A duel must be arranged and agreed upon'
Mouat cheers.
The high justicar asks Guiava the lawyer 'You are questioning her reliability in determining whether the attack was prearanged?'
Shadrim whispers to Mouat Shhhh..
Mouat sits back down.
Guiava the lawyer says to The High Justicar 'I'm saying that "attack" is an emotive phrase, and that our evidence will show the events were more duel-like than the prosecution would have you believe'
Dov looks as if he is about to burst..
The high justicar nods at Guiava the lawyer saying, 'You will have a chance to say that when Sir Veritas is done with the witness.'
Guiava the lawyer nods.
Guiava the lawyer sits down.
The high justicar says to Veritas 'Continue please.'
Veritas bows deeply.
Summer looks to Veritas with lifted brows, waiting to see if she should continue.
Veritas says to Summer 'please tell more if you have more to say'
Veritas says to Summer 'keep to the events at hand please'
Summer says to Veritas 'Kendarick died quickly, before I could do anything to intervene. The guard engaged Drak, and Drak fled the scene.'
Caius rises up.
Caius is red with anger.

The high justicar asks Veritas 'Have you more to say?'
Veritas asks Summer 'Did Kendarick say anything as the battle took place?'
Summer says to Veritas 'Not that I recall.'
Veritas asks Summer 'do you have the ability to speak with the dead?'
Summer says to Veritas 'No, I do not.'
Veritas says 'I have no more questions your honor'

The High Justicar nods at Veritas.
The high justicar says to Guiava the lawyer 'Your witness.'
Guiava the lawyer rises up.
Guiava the lawyer smiles at Summer.

Guiava the lawyer asks 'did Aedwyn try to warn Kendarick it was dangerous to accuse someone he'd just met of being "evil" in such an open place?'

Mouat grits his teeth and fumes with rage.
Summer says 'He said that there were people that might find that term objectionable.'

Guiava the lawyer nods thoughtfully.
Guiava the lawyer says 'you've testified that Kendarick called Drak evil'
Guiava the lawyer asks 'how many times did he say it? Can you recall?'
Dov shakes his head and rubs his eyes
Summer says 'The first meeting, once. The second meeting.. it was two or three times.'
Guiava the lawyer nods.
Veritas looks at Drak.
Guiava the lawyer asks 'now, at the first instance Drak requested a duel to settle the issue honourably, did he not?'

Summer says 'He demanded a duel, yes.'

Guiava the lawyer asks 'yet Kendarick continued to bait Drak without giving him the satisfaction of an honourable solution to the accusation he was "evil"?'

Guiava the lawyer sits down.
Veritas says 'What summer thinks is Honourable may not hold true for all'
Mouat smiles.
Guiava the lawyer rises up.

Summer just watches the lawyer expectantly.

Veritas leans to Kendarick and whispers something.

Summer starts to answer and then stops as Veritas objects.

Guiava the lawyer says 'I'm asking her opinion as an average citizen, which is what my client is'
The high justicar says 'She was asked as an average citizen. Overruled.'
Veritas nods.
Summer considers the question carefully before answering, 'It can be an honorable resolution to a conflict.'
Guiava the lawyer says 'again, as an average citizen...'
Guiava the lawyer looks pointedly at Veritas.
Veritas stares at the sky.
Dov turns red and looks down
Guiava the lawyer asks 'do you think refusing a duel while continuing to bait an opponent is tantamount to provocation?'
Summer asks 'In my own personal opinion? As an average citizen?'
Guiava the lawyer nods.
Summer says 'I would have to say, no, I do not.'
Guiava the lawyer smiles.
Guiava the lawyer says 'I wonder how many others would agree with you on that one'
Mouat raises his hand.
Guiava the lawyer says 'I have nothing further'
Mouat quickly sits back down.

The High Justicar nods at Guiava the lawyer.
The high justicar says 'It has been determine an attack has taken place.'
The high justicar asks Veritas 'Have you a witness to say whether the attack was a dual or not?'
Veritas says 'I believe my next line of questioning will answer that'
The high justicar says to Mouat 'Please remain still or I will be forced to remove you from the court.'
Mouat cringes in terror!
The High Justicar nods at Veritas.
Mouat says to The High Justicar 'my apologies i'm a simply ranger... and not used to formal proceedings like this.'
Dov frowns at what Mouat did.
Veritas says 'I shall now call on Kendarick'
Kendarick rises up.
Dalvyn looks at Mouat.
Summer curtsies to the officials of the court and returns to her seat when so instructed.
Summer sits down.
Mouat looks at Mouat.
Kendarick stands up and walks up to the court.
Dalvyn smiles at Mouat.
Kendarick bows before The High Justicar.
Veritas says 'Kendarick you are under a truth oath in this court'
Veritas asks 'With that shall we continue?'
Eltsac looks at Mouat.
Kendarick says 'yes'
Summer sits next to Telisyn and remains on her best behavior.
Veritas asks Kendarick 'on the night of your untimely demise, was there at any point in your recollection a duel called for?'
Kendarick says to Veritas 'No, I did not hear of a duel nor did I ever refuse one.'
Veritas raises an eyebrow.
Dov whispers to Mouat
Telisyn nods to Summer on a task well done.
A prior says 'As a ranger he must tell the truth.'
Veritas says to Kendarick 'how can this be? The prosecution claims that a duel was offered and ignored by you'
Veritas asks Kendarick 'what words were used then?'
Kendarick says to Veritas 'I did not har about any any duel and thats the truth.'
The High Justicar holds up his hand pausing the discussion.
The high justicar says 'I must clear this up.'
Dov leans back up and watches
The high justicar says 'I find both witnesses to be telling the truth as they see it.'
Mouat looks at Dov.
Shadrim looks toward Dov and smiles, then turns back to the trial.
The high justicar says to Veritas 'You may continue.'
Veritas rises up.
Kendarick says 'If I would have know of a duel I would have accepted it.'
Veritas asks Kendarick 'So the attack upon you took place without your permission?'
Summer questions 'Just as a note, Summer did say that Drak demanded the duel /after/ Kendarick left the Square :)'
Kendarick says to Veritas 'yes'
Veritas says to Kendarick 'I believe you'
Guiava the lawyer rolls her eyes.
Veritas asks Kendarick 'why would the accused attack you in such a manner?'
Kendarick says to Veritas 'Because I called him EVIL and I told him that EVIL people have no respect.'
Drak frowns.
Shadrim raises an eyebrow.
Veritas says to Kendarick 'I see'
Guiava the lawyer places a hand on Drak's shoulder.
Veritas says to Kendarick 'in your opinion was he acting evil or had you cast a spell to detect such a thing'
Kendarick says to Veritas 'No I did not have any detect spells, When he used "treehuggers" I was just some Mad I called him EVIL.'
Guiava the lawyer leans over and whispers to Drak.
Veritas says 'I have no more questions for this witness'

We headed out into Waterdeep and down into the smelly sewers. He head me along a series of twisting tunnels, totally disorientating me. It made me very grateful for the potion of recall I had bought from Meriki the mad wizard earlier. Eventually we came to a place where it seemed there was a wall but there wasnt, and then we were inside this dry hide-out in the sewers. I believe he took me the long way there so as to make sure I would never find my way out or if I did my way back.
 
Waiting for us there was a young human. He never told me his name.

I crept back in and watched them go into a small shrine. It looked like a shrine to Mask.

They then moved out of the shrine and I tried to move without too much clang of armour but they seemed focussed on themselves.

A young male human asks 'Does he answer?'
A young male human asks 'Does he agree?'
Shadrim says 'He wants to know who it is.'
A young male human says 'My name is Jarel of course.'

They then looked my way so I quaffed my potion and left. It seems that the accused was being brought back from the dead by that human priest.
